1. Introduction
Welcome to Buzzkiki, a UK‑based social platform designed for people aged 16 and over. These Terms of Service (“Terms”) govern your use of Buzzkiki, including our website, apps, features, and services (“Platform”).
By creating an account or using Buzzkiki, you agree to these Terms and to all policies referenced within them, including our Privacy Policy, Community Guidelines, and Safety Policy.
If you do not agree, you must not use the Platform.
2. Eligibility & Age Assurance
2.1 Minimum Age
You must be at least 16 years old to use Buzzkiki.
2.2 Age Verification
To comply with the UK Online Safety Act, we may require you to complete age‑assurance checks. These may include document verification, third‑party age‑verification services, or behavioural signals. If you do not complete required checks, we may restrict or suspend your access.
2.3 Creators
To offer paid content or monetised features, you must be:
· 18 or older, or
· Under 18 with a parent/guardian managing the creator account on your behalf.
3. Your Account
You must provide accurate information when creating your account and keep it updated. You are responsible for all activity that occurs under your login credentials.
If you believe your account has been compromised, you must notify us immediately.
We may suspend or terminate accounts that violate these Terms or our safety obligations.
4. Safety & Online Safety Act Compliance
Buzzkiki is a user‑to‑user service regulated under the UK Online Safety Act (OSA). We take reasonable and proportionate steps to:
· Prevent illegal content from appearing on the Platform
· Reduce exposure to harmful content for users aged 16–17
· Enforce our Community Guidelines consistently
· Provide reporting and appeals mechanisms
· Publish transparency information about enforcement
· Conduct regular risk assessments
· Implement safety‑by‑design features
We use a combination of automated tools, human moderation, and behavioural analysis to detect and address harmful or illegal content.
5. Prohibited Content & Conduct
You may not use Buzzkiki to:
· Post or share illegal content
· Bully, harass, threaten, or abuse others
· Promote self‑harm, suicide, or dangerous behaviour
· Share hate speech or discriminatory content
· Share violent or graphic content
· Impersonate others
· Circumvent age‑assurance measures
· Interfere with the Platform’s technical operation
· Infringe intellectual property rights
· Engage in fraud or deceptive practices
We may remove content, restrict features, or suspend accounts that violate these rules.
6. Harmful Content (16–17 Protections)
For users aged 16–17, we may restrict or add warnings to content involving:
· Bullying or harassment
· Hate speech
· Self‑harm or suicide references
· Violence
· Dangerous challenges or behaviour
· Sexual content (non‑explicit)
We may also limit visibility or apply additional safety filters.
7. Reporting & Appeals
7.1 Reporting
You can report content or behaviour that violates these Terms or the OSA. Reports are reviewed in a timely manner.
7.2 Appeals
If you disagree with an enforcement action, you may submit an appeal. We will review appeals and provide a response within a reasonable timeframe.
8. Creator Terms
Creators may offer content, subscriptions, digital items, or other benefits to fans.
8.1 Fees
Buzzkiki charges:
· 7% service fee on creator transactions (subscriptions, tips, locked content, digital/physical products)
· 10% service fee on Marketplace transactions and Ad transactions
· Payment processing fees (e.g., 2.9% + £0.30 per transaction)
8.2 Payments
We may delay or block payments for:
· Fraud prevention
· Compliance checks
· Tax reporting requirements
· Safety investigations
Negative balances may be recovered from future earnings.
8.3 Tax
Creators are responsible for reporting income. Buzzkiki collects and remits VAT or other transactional taxes where required.
8.4 Restrictions
Creators may not offer:
· Illegal or harmful content
· Sexual content involving real people
· Gambling, raffles, or chance‑based rewards
· Content infringing intellectual property
· Misleading or fraudulent benefits
Creators must protect fan data and may not sell or transfer their accounts.
9. Fan Terms
Fans may subscribe to creators on a free, monthly, or per‑creation basis. You may cancel at any time.
Access to creator content ends when:
· You cancel
· Your payment fails
· The creator blocks you
· The creator deletes their account
· We suspend your account
Refunds are generally not offered but may be granted at our discretion.
10. Intellectual Property
10.1 Your Content
You retain ownership of your creations. By posting on Buzzkiki, you grant us a worldwide, non‑exclusive, royalty‑free, sublicensable licence to use, display, distribute, and promote your content solely for operating and improving the Platform.
10.2 Our Content
Buzzkiki’s trademarks, branding, and platform assets are protected. You may use our branding only as permitted in our Brand Guidelines.
11. Third‑Party Services
You may connect third‑party accounts (e.g., Google, YouTube, Instagram). You control these permissions and may revoke them at any time.
12. Account Suspension & Termination
We may suspend or terminate accounts that:
· Violate these Terms
· Violate the OSA
· Pose safety or legal risks
· Engage in fraud or abuse
You may delete your account at any time. We may retain certain information for safety, compliance, or legal reasons.
13. Risk Assessments & Safety by Design
We conduct regular risk assessments of:
· Features
· User journeys
· Content types
· Safety systems
We design Buzzkiki with safety features including:
· Reporting tools
· Content filters
· Anti‑bullying systems
· Wellbeing nudges
· No infinite scroll
· No dark patterns
14. Disclaimers
Buzzkiki is provided “as is” without warranties of any kind. We do not guarantee uninterrupted service or error‑free operation.
15. Limitation of Liability
To the extent permitted by law, our liability to you is limited to £100. We are not liable for indirect, incidental, or consequential damages.
16. Indemnity
You agree to indemnify Buzzkiki Ltd and its affiliates against claims arising from your use of the Platform or your violation of these Terms, including claims related to the Online Safety Act.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of England and Wales.
Disputes must be resolved through individual arbitration in the UK, except where court action is required for injunctive or intellectual‑property matters.
18. Changes to These Terms
We may update these Terms from time to time. If changes materially affect your rights, we will notify you before they take effect. Continued use of Buzzkiki means you accept the updated Terms.
